     No, I replied, not wanting anything more or less then what’s on a “dollar menu” for cup I could refill, if need be. I handed over $1.06 in change, placing it carefully on the counter in front of the short blonde teenage girl. “It’s 50 cents,” she quipped, all bright and full of sunshine. “It’s a senior cup.”

Street Corner Society Beckoned to Me

  • Corner Lounging. Police picked us up more times than I can remember simply for hanging out and making a little too much noise, perhaps, with a little too much profanity.
  • I didn’t. Use profanity. Not much. And when I did, I think it meant something. Not like today, when the “F” word is bantered around too freely. And way too often. And, that’s in so-called “polite society.”

     We were young kids drawn to older kids who had little to occupy their time except hang out in our geographic circles, aka, the street corner. The “coolest” ones, the teenagers with the nice outfits and a quip for anything anti-establishment, got the most attention and adulation. I looked up to those “old heads” who could cuss up a storm and strut their stuff in walking down a street. And those were just the girls!

     Like Midge Connerton. I think she was the first of the opposite sex that I noticed was more of a woman than a girl. Seem to always wear oversized sweat shirts (probably belonged to “Beanie” her brother) and jeans that rolled up at the end. Smoked cigarettes. And caused kids like me, two to three years younger than her, to look up to her as both a “roll” model, and a model you wouldn’t mind “rolling around with.

Admiring a Young Girl’s Appearance

     She was cute. And had breasts. At the age of 12 and 13, they stood out. They got attention, is what I mean. You put them in the mix with corner-lounging, cursing and smoking, and you got yourself a one-way ticket to juvenile delinquency and teenage pregnancy, is what our parents thought. We viewed it as juvenile delicacies and teenage prep for adulthood.

     Good kids for the most part, cops would label all as trouble-makers, running us in, based on some flimsy complaint with the hope of scaring us off the corners. We’d go right back after our parents would “bail us out of the police precincts, lecturing us, as we’d swear before the Almighty we’d never do again whatever it was we were accused of doing in the first place.

Pitching pennies properly

     My mother learned about this police work” the hard way. Four or five of us barely into our teens were “pitching” pennies outside of our house at 31st Street and Girard Avenue in a section of Philadelphia called Brewerytown.

     My brother, John, and I were using pennies we got from a jar my mother was saving them in.

     Charlie Dell A’Casa, our next door neighbor, used his own pennies as did the other kids, all ranging from twelve to 14. (I was the youngest.)

Nabbed by Police for Pitching Pennies 

     A “red car” drove up the wrong way of 31st Street and pulled onto the pavement as two police officers jumped out of police car — all in red at that time — and rounded us up, grabbing the pennies lying on the pavement as evidence of our crimes. None would listen to what any of us had to say. Got threatened by one of the cops to shut up “or else,”  as he indicated with body language what he would do with th club he carried on him.

     Mom heard the racket inside the house, came out, and the last I seen her, she was holding open the screen door, shouting at the cops “They were my pennies. I gave them to ’em to play!

     Did no good. The law is the law. And a complaint is a complaint, no matter what or where it may have originated. Or whether it was ever founded or not.

     We got released. But got no lecture from our folks this time. Never did “pitch” pennies again. The object was to get as close to the wall with your penny to win. We played the game with a deck of cards instead of money from then on. Learned to move our “Corner-Lounging” away from those corners that gathered the most complaints too. It was all part of the learning process in growing up in the city. Tough but educational. Just like Life.

     What happened in the Vietnam War is another story, but my next Angel appeared as a burly Scottish neighbor of my parents, who had moved from the inner city of Philadelphia to one of its suburbs, Wayne, Pa. “What will you major in at college, Laddy?” the neighbor asked when I visited my folks advising them that I would be using their address to attend the Delaware County Community College. (I lived outside the county and would have had to pay double the amount if I didn’t fudge the location of my domicile.)

A Jury can ‘nullify’ a law to stop injustice

Mandatory Sentence

     In at least one country, as a practicing attorney, I would not be permitted to speak to you of those two terms should you happen to be serving on a jury.

     See, the government thought it wiser to keep that information away from a jury hearing a trial in a criminal case. Some jurors might want to take the law into their own hands, so to speak.

    That’s what jury nullification actually is. A jury has the power to “nullify” a law it does not want to follow. Understand that? If you feel the law would be unjust, you can simply decide not to apply the law.

     Can anyone spell anarchy? That’s what would happen if every jury swore in to uphold the law took it upon itself to disregard it. But I’m not talking about every case. Just the exceptional one where 12 people agree that the application of the law would cause more harm than good.

Mandatory Sentence Could Mean Years in Jail

     Kinda goes along with Mandatory Sentences. Defense lawyers in this same country are not permitted to tell a jury that its verdict will lead to mandatory outcomes, no matter what a jury might have been led to believe. Studies show that most juries believe defendants usually end up getting probation or some “light” sentence. But state legislators in this country wanted to ensure no “lenient” judge could get away with not “sending someone away,” no matter what the circumstances for certain offenses.

     A lot of “mandatory” sentences have to do with crimes against victims of a certain age. Do you know if you strike a child of a certain age, the law mandates that you serve at least one year in jail, no matter what? Unless a prosecutor agrees to “demandatorize” a sentence, a babysitter 18 or older slapping a child of a certain age must serve 365 days in jail upon conviction, at least in the part of the country I’m talking about.

Stiff Sentences are Okay for Certain Offenses

     A young man who is led to believe the young female he spent the night with was over a certain age, faces a similar mandatory sentence. It’s called statutory rape, no matter what lies the person under 14 offered, or the lack of intent to commit any crime when he had consensual sex.

     Most may say the sombitch deserves it. Unless it is a member of their family, a close friend, or, God forbid, themselves.

     Or got involved with drugs and had in your possession an amount that presupposes possession with the intent to deliver, which calls for, you guessed it, a mandatory sentence, no matter what the circumstances.

Felony Charge Could Apply for Marijuana

     I was shocked when I learned a person who simply possessed a certain amount of marijuana could be charged with a felony for selling dope.

People I knew in my teens often purchased an ounce or more.

If they’d put the grass in small zip lock bags for later use and or convenience, the packaging of the marijuana itself could lead to a rebuttable presumption that it was for the “intent to deliver.”    

Well, a jury could disregard the law if it saw fit

     But I was never allowed to tell a jury in Philadelphia that it had such power. Not permitted to even mention a mandatory sentence, or I’d face contempt charges from a judge.

Sentencing is not in the “province” of the jury; only guilt or innocence is what a judge would instruct me after my imprisonment, monetary fine, or both.

History Shows we can Disregard the Law Sometimes!

     Could not tell a jury in America that landmark cases such as those involving William Penn, the founder of Pennsylvania, or John Peter Zenger, a New York printer whose case stood for both Freedom of the Press and Truth as a Defense Against Libel, were kept from imprisonment because a jury saw fit to disregard the law each brave man had so clearly broken. They were found “Not Guilty,” despite the law. Some might say “in spite” of the law.

     A dream I had last night inspired me to whisper this piece of advice to you, should you ever serve on a jury. Go ahead. Disregard the law if you, in all “good consciousness,” feel it’s the right thing to do.

     It really is the American Way, no matter what my government won’t allow me to tell you.
